JADID KHATA POS – Terms of Service & Conditions

These Terms of Service (“Terms”) govern your access to and use of the Jadid Khata POS Platform (“Platform”, “Service”, or “Software”), operated by Mushwari Pvt. Ltd. (“Jadid Khata”, “we”, “our”, or “the Company”).
By accessing or using Jadid Khata POS, you agree to be bound by these Terms. If you do not agree, please do not use or access the Service.

1. Acceptance and Modification of Terms

The Company reserves the right to update or modify these Terms at any time without prior notice. Any changes will become effective immediately upon posting on our website or within the software. Continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
It is your responsibility to review these Terms periodically.

2. Use of the Service

You agree to use Jadid Khata POS only for lawful business purposes and in accordance with these Terms.
The Company may, at its sole discretion, suspend or terminate your access if it believes your use violates any applicable law or these Terms.

3. Limitation of Liability

In no event shall Jadid Khata or Mushwari Pvt. Ltd. be liable for:
(a) any indirect, incidental, special, consequential, or punitive damages (including but not limited to loss of data, profits, revenue, or business interruption) arising from your use or inability to use the Service;
(b) any error, omission, or inaccuracy in the information or materials provided.

Where limitation of liability is not permitted by law, our liability shall be limited to the maximum extent allowed.

You are solely responsible for maintaining regular backups of your business data, invoices, and database.

4. Copyright and Intellectual Property

All content, including text, graphics, logos, source code, and design, are the intellectual property of Mushwari Pvt. Ltd. or its licensors and are protected under applicable copyright and trademark laws.
You may not reproduce, distribute, modify, or reverse-engineer any part of the Platform without written consent from the Company.

You may use the software only for your own licensed business operations.

5. Indemnification

You agree to indemnify and hold harmless Mushwari Pvt. Ltd., its affiliates, employees, and partners from any claims, damages, or losses (including legal fees) resulting from your misuse of the Service or violation of these Terms.

6. Product Functionality

All Jadid Khata POS modules are thoroughly tested to function on a properly configured server environment (PHP/MySQL). The Company guarantees compatibility with a clean default installation.
If issues occur, our support team will assist in identifying and resolving them.

7. Refund Policy

We aim for complete customer satisfaction.
If you find that the purchased product does not function as described in our documentation or demo, you may request a refund within 5 days of purchase.
Refunds are not available after 5 days.
We strongly recommend testing the free trial/demo version before purchase.

8. Software License

Each license is valid for a single business entity or domain unless otherwise stated.
Misuse, unauthorized distribution, or sharing of license keys may result in termination of support and/or license revocation.

9. Privacy Policy

We respect your privacy.
All user data collected during registration or service use is treated as confidential and will never be sold or shared with third parties without consent, except as required by law.

10. Security

Users are responsible for maintaining the confidentiality of their account credentials.
You must not use the Platform to compromise system security or attempt unauthorized access to data or servers.
The Company reserves the right to investigate and cooperate with law enforcement authorities in cases of suspected violations.

Support is available to all paying customers through our official support channels.
Our team typically responds within a few hours (or up to 24 hours on weekends).
Support includes assistance with installation, configuration, and general usage issues.

12. Server Requirements

To ensure optimal performance, the Platform requires a properly configured server running PHP and MySQL.
Most standard hosting environments meet these requirements.
It is the customer’s responsibility to ensure that their hosting environment meets the minimum specifications.

13. Product Delivery

Jadid Khata POS is a digital product. Delivery occurs instantly via email or within your user dashboard after payment.
If you do not receive your activation or download link, please check your spam/junk folder or contact support for reissuance.

14. Third-Party Links

Our Platform may include links to third-party websites.
We do not control or endorse the content, policies, or practices of these external sites and disclaim any liability for their actions.

15. Changes to Terms

The Company may revise these Terms at any time without prior notice.
Continued use of the Service after updates constitutes your acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan (or applicable jurisdiction of incorporation).
